390.   Minister to attempt mediation

  1.  

    (1)   Notwithstanding the provisions of section 389, where a trade dispute exists or is contemplated the Minister may, if in his or her opinion such dispute is likely to be harmful to the public interest, intervene in the dispute or pending dispute, for the purposes of mediation.

    (2)   Where the Minister intervenes under subsection (1), he or she shall take such steps as he or she deems expedient for promoting a settlement of the dispute including the summoning of the parties together to attempt reconciliation.

    (3)   If the Minister fails at promoting a settlement to the dispute, he or she shall notify the parties to the dispute and thereafter be referred to the Tribunal for settlement.
