31.   Meal intervals

  1.  

    (1)   An employer shall not require an employee—

    1.  

      (a)     subject to subsection (2), to work for more than 5 hours continuously without a meal interval of not less than one hour; or

    1.  

      (b)     to perform any work during the meal interval, without the consent of that employee.

    (2)   Where an employee works a split shift or an occasional shift in accordance with section 30, the employee shall be entitled to a meal interval of not less than one hour after each 5 hours of continuous work, but the second meal interval may, on the mutual agreement of the employee and the employer, be shortened to less than an hour.

    (3)   Notwithstanding subsection (1) or (2) an employer and an employee may mutually agree to vary the meal interval—

    1.  

      (a)     so that a one hour meal interval is divided into shorter breaks including at least one break of half an hour;

    1.  

      (b)     to allow the employee a 10 minute break within the 5 hour period.
