163.   Payment to beneficiary and complaint against non-payment

  1.  

    (1)   Where a contract of employment is terminated by reason of the death of an employee, termination benefit shall be paid to—

    1.  

      (a)     the named beneficiary; or

    1.  

      (b)     in the absence of the named beneficiary, the surviving spouse of the deceased employee; or

    1.  

      (c)     in the absence of a spouse or named beneficiary of the deceased employee, to such other dependent relative of the deceased employee as the court may decide.

    (2)   A complaint that termination benefits have not been paid within 2 weeks from the date of termination may be taken to court, and if the complaint is found to be proven to the satisfaction of the court, it shall order payment of the amount due.
