(1) Where one of the purposes of a sale or other disposition of a business or part of a business is to enable an employer to avoid any of his or her obligations under this Act or to deprive any employee of any right under this Act, all of the obligations of the person selling or otherwise disposing of the business under this Act shall be binding on the person acquiring the business or part of a business.
(2) Nothing in subsection (1) shall be interpreted as restricting an employer from making a bona fide sale of his or her business or part of a business.
