(1) Where the employee is not performing his or her duties in a satisfactory manner, the employer shall give him or her a written warning and appropriate instructions to correct the unsatisfactory performance.
(2) If the employee, after being warned a further 2 times after the warning in subsection (1), does not at any time during the following one month period demonstrate that he or she is able to perform and has performed duties in a satisfactory manner, the employer may dismiss the employee.
