(1) Subject to section 374, a representative of a certified trade union at the workplace shall have appropriate time during work hours as is necessary for the performance of his or her duties as the representative and shall not suffer any detriment, discrimination or disadvantage, including any loss in normal pay by reason of such representation.
(2) In determining what is appropriate time, due regard shall be given to the efficient operation of the enterprise.
