(1) A person shall not publish or display or cause or allow to be published or displayed, any advertisement or notice which indicates or could reasonably be understood as indicating, an intention to commit a breach of any provision under this Division.
(2) A publisher or person displaying an advertisement made unlawful by subsection (1), shall not be subject to any liability under that subsection if the publisher or person proves—
(a) that the advertisement was published or displayed in reliance on a statement made by the person who caused it to be published or displayed to the effect that the publication would not be unlawful; and
(b) that it was reasonable for the publisher or person displaying to rely on that statement.
(3) A person who contravenes subsection (1) or who makes a statement referred to in subsection (2) which is false or misleading in a material respect commits an offence and is liable on summary conviction to a fine not exceeding $5,000.
