237.   Notice for new chemicals or biological agents

  1.  

    (1)   Except for purposes of research and development, a person shall not—

    1.  

      (a)     manufacture;

    1.  

      (b)     distribute; or

    1.  

      (c)     supply;

for commercial or industrial use in a workplace any new chemical or new biological agent unless the person first submits to the Department of Labour notice in writing of the person's intention to manufacture, distribute or supply such new chemical or agent and the notice shall include the ingredients of such a new chemical or agent and their common or generic names, the composition and properties and relevant safety data sheets.

    (2)   Where, in the opinion of the Chief Occupational Safety and Health Officer, which opinion shall be made within 24 hours, the introduction of the new chemical or new biological agent referred to in subsection (1) may endanger the safety or health of the employees in a workplace, the Chief Occupational Safety and Health Officer shall require the manufacturer, distributor or supplier, as the case may be, to provide, at the expense of the manufacturer, distributor or supplier, a report or assessment, made or to be made by a person possessing such special, expert or professional knowledge or qualifications as are specified by the Chief Occupational Safety and Health Officer, of the new chemical or agent intended to be manufactured, distributed or supplied and the manner of use.

    (3)   For the purpose of this section, a chemical or biological agent is not considered to be new if, before a person manufactures, distributes or supplies the chemical or agent in Saint Lucia, it was used in a workplace other than the person's workplace in Saint Lucia, or it is included in an inventory compiled or adopted by the Department of Labour.
