178.   Non-compliance with notice

  1.  

    (1)   An employer or person in control of an industrial establishment shall not, after the period named in the notice under section 177, employ the young person to whom the notice relates contrary to requirements set out in the notice, unless a medical inspector has, after the service of the notice, personally examined the young person and certified that he or she is fit for employment in the industrial establishment or in the process or kind of work, as the case may be.

    (2)   An employer or person in control of an industrial establishment who fails to comply with subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $5,000 or imprisonment to a term not exceeding one year or both.
