(1) Except where provision is made under this Act for a complaint to be addressed directly to the Tribunal, any complaint made by an individual, alleging a contravention of any of the provisions of this Act, shall be made to the Labour Commissioner in the first instance.
(2) Upon receipt of a complaint under subsection (1), the Labour Commissioner may refer the matter to the Tribunal for determination.
