(1) A trade union claiming to have as members in good standing a majority of the employees of an employer in a bargaining unit may, subject to this Division, make an application to the Labour Commissioner to be certified as the exclusive bargaining agent of the employees in the bargaining unit.
(2) All existing trade unions which were certified as bargaining agents immediately before the coming into force of this Division shall be deemed to be certified.
