291.   Postponement of return

  1.  

    (1)   An employee may postpone her return to work for a total period of not more than 60 days without pay if, before the notified day of return, she gives her employer a certificate from a medical practitioner stating that, by reason of disease or physical or mental disablement arising out of, or connected with her pregnancy or of her newborn child, she will be unable to return to work on the notified day of return.

    (2)   Where an employee exercises her right to postpone her return to work under subsection (2), she shall suffer no prejudice and no discrimination.

    (3)   If an employee has notified a day of return and an intervening interruption of work whether due to industrial action or some other reason outside of the control of the employee renders it unreasonable to expect the employee to return to work on the notified day of return, she may instead return to work when work resumes.

    (4)   For the purposes of this section “notified day of return” means the day on which the employee intends to return as notified to her employer under subsection (1).
