365.   Restrictions in conduct of poll

  1.  

    (1)   In relation to the conducting of a secret poll a person shall not—

    1.  

      (a)     seek, on any premises on the day on which the secret poll is being held or within 100 yards of such premises, to influence an employee to vote or refrain from voting for a trade union; or

    1.  

      (b)     wilfully obstruct any person from voting or carrying out any function imposed on that person under this Division.

    (2)   A person who contravenes subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding one month or to both.
