111.   Established rates and conditions of employment

  1.  

    (1)   The contractor shall pay rates of remuneration and observe hours and conditions of employment no less favourable than those established in the trade or industry in the district where the work is carried out by agreement, negotiation or arbitration by employers and trade union representatives of substantial proportions of the employers and employees engaged in the trade or industry or district, to be called “established rates and conditions”.

    (2)   In the absence of any established rates and conditions referred to under subsection (1), the rates and conditions of employment in other districts where the trade or industry is carried on under similar circumstances shall be deemed to be the established rates and conditions.

    (3)   Established conditions of employment shall be no less favourable than those set out under this Act, and where such conditions are less favourable, the conditions established under this Act shall prevail.
