(1) Except where otherwise provided in this Division, a person alleging a violation of this Division shall bear the burden of presenting a prima facie case of discrimination or an offence related to discrimination.
(2) Upon a prima facie showing of discrimination, the burden of proof shall shift to the respondent to disprove the allegations.
