63.   Employers to issue details of wage payments

  1.  

    (1)   An employer shall, at the time of paying wages to an employee, provide that employee with a wage slip containing the following written details in respect of the wage period to which the wages relate—

    1.  

      (a)     the name of the employee and his or her occupation;

    1.  

      (b)     the wage rate of the employee;

    1.  

      (c)     the period to which the wage relates;

    1.  

      (d)     in the case of daily paid workers, the number of hours paid for at ordinary time;

    1.  

      (e)     the number of hours paid for at overtime rate;

    1.  

      (f)     the nature and amount of any bonuses or allowances paid;

    1.  

      (g)     the gross wages earned by the employee;

    1.  

      (h)     the amounts and reasons for any deductions made from the gross wages; and

    1.  

      (i)     the amount of the net wage paid to the employee.

    (2)   The acceptance of wages or a wage slip by an employee without protest or reservation shall not prejudice his or her right to recover all or any part of wages due to him or her.

    (3)   Where under his or her contract of employment, an employee is entitled to a commission or share of the profits of the undertaking in which he or she is employed, the employee shall, at the time such commission or share is paid to him or her, be provided with full details as to the method of calculation of the commission.
