12.   Types of contract

  1.  

    (1)   A contract of employment may take one of the following forms—

    1.  

      (a)     a contract without reference to limit of time;

    1.  

      (b)     a contract for a specified period of time; or

    1.  

      (c)     a contract for a specific task.

  1.  

    (2)   A contract of employment may be terminated by either party subject to the provisions of this Act concerning unfair dismissal and notice of termination.

    (3)   A contract of employment for a specified period of time shall be automatically terminated on the date specified for its termination and no notice shall be required for its termination at that time, but termination at any other time shall be subject to the provisions of this Act concerning unfair dismissal and notice of termination.

    (4)   A contract of employment for a specific task shall terminate on the completion of the task and no notice of termination shall be required by either party.

    (5)   Where the purpose or effect of a contract of employment that is purportedly for a specified period of time or for a specific task is the filling of a post connected with the normal and permanent activity of the enterprise for a period of over 2 years of continuous employment as defined under this Act, it shall be deemed a contract without reference to limit of time.

    (6)   Where a contract of employment provides for a probationary period, an assessment of the employee shall be undertaken during the probationary period and such assessment shall be communicated to the employee prior to the end of the probationary period.
