204.   Representation during inspections

  1.  

    (1)   Where an authorized officer makes an inspection of a workplace, the employer shall afford a committee member representing employees or a safety and health representative, if any, or an employee selected by a trade union or trade unions, if any, to represent it and where there is no trade union, an employee selected by the employees to represent them, the opportunity to accompany the authorized officer during the physical inspection of a workplace, or any part.

    (2)   Where there is no member of a committee representing employees, or safety and health representative, or employee selected in accordance with this Division, the authorized officer shall consult during the physical inspection with a reasonable number of the employees concerning matters of safety and health at their workplace.

    (3)   The time spent by a member of a committee representing employees, a safety and health representative or an employee selected in accordance with this Division in accompanying an authorized officer during an inspection, shall be deemed to be work time of which he or she shall be paid by the employer at his or her regular rate.
