(1) Subject to subsection (2), where a family member of the employer is engaged in the work of an enterprise, he or she may not be treated as being an employee engaged under a contract of employment in accordance with the provisions of this Division unless there is a written contract between that family member and the employer.
(2) Subsection (1) shall apply only where that family member has agreed to such exemption.
