(1) In relation to the conducting of a secret poll, every employer shall—
(a) take all necessary steps to ensure that the employees who are eligible to vote in a secret poll are given the opportunity to do so;
(b) permit each such employee to be absent from work, for a reasonable period of time not to exceed 2 hours, without pay deduction for the purpose of voting; and
(c) facilitate the conduct of a secret poll on the premises of the employer.
(2) Notwithstanding subsection (1)(c), where the premises of the employer are unsuitable or inappropriate, the Labour Commissioner in consultation with the employer and the union shall determine an alternative venue for the conduct of the secret poll. (Inserted by Act 6 of 2011)
