(1) Nothing in this Division affects—
(a) a provision in a deed, will or other document, whether made before or after the coming into operation of this Part, that confers charitable benefits or enables charitable benefits to be conferred on persons on the basis of the grounds set out in section 267(2); or
(b) an act that is done in order to give effect to such a provision.
(2) In this section “charitable benefits” means benefits for purposes that are exclusively charitable according to existing laws.
