939.   Omission of juror believed absent or dead

  1.  

    (1)   It is lawful for the sheriff not to issue a summons for a juror in any case where he or she has a reason to believe that the juror is dead or absent from this State, or will be so absent at the time of the sessions of the Court.

    (2)   Any person so omitted shall, if in fact not dead, or if in this State and available, be summoned for the next or subsequent session of the Court.
