776.   Reduction of charge from indictable to summary offence

Notwithstanding the provisions of section 774 (4) and section 775 (6) (b), where, on the holding of any sufficiency hearing on a charge of an indictable offence, the magistrate is of the opinion that the evidence establishes or appears to establish, the commission of a summary offence of a kind similar to the offence charged or an abetment, or an attempt or incitement to commit that summary offence, the magistrate may, if he or she thinks fit, inform the accused person accordingly, and all further proceedings thereafter in the matter shall be the same as if a complaint had been made against the person for the offence or abetment, attempt or incitement.
