870.   Use of deposition and Judge's notes to try plea of autrefois acquit or convict

On trial of an issue on a plea of autrefois acquit or autrefois convict, the written statements and depositions transmitted to the Court on the previous trial, together with the Judge's notes, if available, and the written statements and depositions transmitted to the Court on the subsequent charge, are admissible in evidence to prove or disprove the identity of the charges.
