1021.   Court to remit summary case to Magistrate or to try it

If, before or during the trial of any person for an indictable offence, it appears to the Court that the person is not guilty of the indictable offence but guilty of a summary offence, the Court may remit the case to a magistrate with such directions as it may think fit, or allow the case to proceed, and, in case of conviction, impose such punishment upon the person so committed as a magistrate would have imposed in respect of the offence.
