660.   Transfer case to district court having jurisdiction

  1.  

    (1)   If, upon the hearing of any complaint, it appears that the cause of complaint arose outside the jurisdiction of the court before which such compliant is brought, the magistrate may, on being satisfied that the court has no jurisdiction, direct the case to be transferred to the court having jurisdiction where the cause of complaint arose.

    (2)   Where the defendant is in custody and the magistrate thinks it expedient that the defendant should continue to be in custody or, if he or she is not in custody, that he or she should be placed in custody, the magistrate shall direct that the defendant be taken by a police officer before the magistrate having jurisdiction where the cause of complaint arose.

    (3)   The magistrate shall issue a warrant for that purpose to the police officer, and deliver to him or her the complaint and recognizances, if any taken by him or her, to be delivered to the magistrate before whom the defendant is to be brought, and the complaint and recognizances, if any, shall be treated to all intents and purposes as if they had been taken by that magistrate.

    (4)   Where the magistrate makes no order that the defendant should continue to be kept, or should be placed in custody, he or she shall transfer the case in accordance with the provisions of subsection (3) and inform the accused accordingly.

Appearance of Defendant
