The proprietor of any newspaper is presumed to be criminally responsible for defamatory matter inserted and published in the newspaper, but such presumption may be rebutted by proof that the particular defamatory matter was inserted and published in the newspaper without knowledge of the proprietor or negligence on his or her part.
