983. Offence charged — conviction for another
If, in the case mentioned in section 833 the accused is charged with a particular offence, and it appears by the evidence that he or she committed a different offence for which he or she might have been charged under the provisions of that section, he or she may be convicted of the offence which he or she is proved to have committed, although he or she was not charged with that offence.
