758.   Execution for appeal costs

  1.  

    (1)   If payment of costs is not made, the person entitled to it may apply to the district court for an order of execution as if the judgment or order as to costs was a judgment given in the district court in the exercise of its civil jurisdiction.

    (2)   The magistrate may also, on application by or on behalf of the person entitled to such costs, commit the person by whom it is payable to a correctional facility for any term not exceeding 2 months, in addition to any term of imprisonment to which he or she may be otherwise liable under the judgment in the case, unless the amount of such costs and all unpaid costs and charges of the execution if any, or otherwise, and the costs of the commitment, if the magistrate thinks fit so to order, are sooner paid.
