764.   Recognizance by applicant

If a case is stated on the application of a party, the party, (hereinafter called the “appellant”), shall, at the time of making his or her application enter into recognizance with one or more sureties acknowledged before the magistrate or the clerk of the Court on condition to appear and prosecute his or her appeal and to abide by the judgment of the Court, as well as pay such costs as may be awarded by the Court.
