991.   Verdict on charge of rape, etc.

Upon the trial on indictment of a person charged with rape, or with the offence of having sexual intercourse or sexual connection with a male or female under the age of 12 years, he or she may be convicted of any offence which is established by the evidence, and of which the unlawful sexual intercourse or sexual connection with a male or female, whether of a particular age or description or not, is an element, or of which procuring the male or female to have unlawful sexual intercourse or sexual connection with any male or female is an element, or he or she may be convicted of any of the following offences—

  1.  

    (a)     administering to the male or female, or causing him or her to take any drug or any other thing, with intent to stupefy or overpower him or her, in order to enable any male or female to have unlawful sexual intercourse or sexual connection with him or her;

  1.  

    (b)     unlawfully and indecently assaulting the male or female;

  1.  

    (c)     a common assault.
