CHAPTER FIRST
THE RIGHT OF ACCESSION IN RESPECT OF WHAT IS PRODUCED BY A THING

    364.   The natural and industrial fruits of the earth, civil fruits, and the increase of animals, belong to the proprietor by right of accession.

    365.   The fruits produced by a thing, only belong to the proprietor subject to the obligation of restoring the cost of the ploughing, tilling, planting, weeding, and sowing done by third persons.

    366.   A mere possessor only acquires the fruits in the case of his or her possession being in good faith; otherwise he or she is obliged to give the produce as well as the thing itself to the proprietor who claims it.

    A possessor in good faith is not bound to set off the fruits against improvements for which he or she has a right to be reimbursed.

    367.   A possessor is in good faith when he possesses in virtue of a title the defects of which as well as the happening of the resolutory cause which puts an end to it are unknown to him or her. Such good faith ceases only from the moment that these defects or the resolutory cause are made known to him or her by proceedings at law.
