79. If a father have disappeared, leaving minor children issue of his or marriage, the mother has the care of such children and exercises all the rights of her husband as to their person and as to the administration of their property, until a tutor is appointed.
80. After the disappearance of the father, if the mother be dead or unable to administer the property, a provisional or a permanent tutor may be appointed to the minor children.
