173.   Claims on abandoned property

  1.  

    (1)   Any person claiming an interest —

    1.  

      (a)     in any property which has been paid into the custody of the Central Bank;

    1.  

      (b)     in any property delivered into the custody of the Minister; or

    1.  

      ©     in the proceeds from the sale of the property by public auction,

may, prior to the expiration of the periods under sections 169 and 172(4) file a claim for that interest by a claim form supported by affidavit evidence.

    (2)   The Minister on the recommendation of the Central Bank shall by Regulations prescribe the —

    1.  

      (a)     claim form;

    1.  

      (b)     persons to whom a claim form may be issued;

    1.  

      ©     required documentation to accompany each claim;

    1.  

      (d)     procedures for filing the claim form;

    1.  

      ©     process for the approval of claims;

    1.  

      (f)     procedures for the payment of claims and for reimbursements.

  1.  

    (3)   Upon the expiration of the periods under section 169(4) and section 172(4) no person may make any claim against the Central Bank or the Crown in respect of the property.

    (4)   Any person aggrieved by a decision of the Central Bank or the Minister may commence an action in the High Court to establish his claim within 30 days following the decision of the Central Bank or the Minister.
