19.   Delivery of articles on leaving the Fire Service

  1.  

    (1)   Unless specially authorised to do so by regulations a member of the Fire Service shall not be entitled to keep or use for his or her own private use and benefit any article whatsoever supplied to him or her at public expense, but he or she shall hold every such article at the order and disposal of the Chief Fire Officer.

    (2)   Every member of the Fire Service who is dismissed from the Fire Service, or resigns from or otherwise leaves the Fire Service shall immediately deliver over to the Chief Fire Officer or the person appointed by the Chief Fire Officer for that purpose all articles which have been supplied to him or her at the public expense, and which he or she has not been expressly authorised to keep or use for his or her private benefit.

    (3)   Every person who contravenes the provisions of this section is liable on summary conviction to a fine of $50 or to imprisonment for a term of 3 months; and it is lawful for any justice of the peace to issue his or her warrant to search for and seize all such articles which are not so delivered over, wherever the same may be found, and to arrest the person in whose possession the same may be found.
