13.   Illegally withdrawing from force

  1.  

    (1)   Every subordinate officer and fire fighter who—

    1.  

      (a)     absents himself or herself from roll call or from duty for the space of 24 hours without lawful excuse; or

    1.  

      (b)     resigns from or leaves the Fire Service without the permission of the Governor General,

    is deemed to have illegally resigned from or left the Fire Service and is liable on summary conviction to a fine of $150 or to imprisonment for 3 months.

    (2)   It is sufficient on any complaint for any offence under this section to state that the person proceeded against did illegally resign from or leave the Fire Service and the onus of proving that any resignation or withdrawal was with the permission of the Governor General shall be on the person proceeded against.
