41. Declaration of Interest and Abstention from Voting

(1) A member of the Council shall, as soon as is practicable, make a declaration to the Chairperson of a matter in which he or she has, directly or indirectly, personally or by his or her relative, partner, business associate or company, a pecuniary or business interest and that member shall not take part, directly or indirectly in a meeting of the Council on that matter.

(2) Where a member declares an interest under subsection (1), the member of the Council shall depart the meeting on the matter coming up for discussion and shall not receive any other communication on the matter.

(3) A declaration and the departure of a member of the Council from the meeting in accordance with subsections (1) and (2) shall be noted in the minutes of the meeting.

(4) A member of the Council is guilty of misconduct and section 30(1)(c) applies if he or she —
1. (a) contravenes subsection (1) or (2);
1. (b) votes in respect of a matter before the Council in which he or she is interested, whether directly or indirectly;
1. (c) seeks to influence the vote of any other member of the Council in relation to a matter before the Council in which he or she is materially interested, whether directly or indirectly.
