108.   Promotion of goods or service

  1.  

    (1)   A supplier of goods or service shall not promote any goods or service —

    1.  

      (a)     in a manner that is misleading, fraudulent or deceptive in any way, including in respect of —

      1.  

        (i)     the nature, properties, advantages or uses of the goods or service,

      1.  

        (ii)     the manner in or conditions on which the goods or service may be purchased, leased or otherwise acquired,

      1.  

        (iii)     the price at which the goods may be acquired, or the existence of, or relationship of the price to, any previous price, or competitors price for comparable or similar goods or service,

      1.  

        (iv)     the sponsoring of any event, or

      1.  

        (v)     any other material aspect of the goods or service;

    1.  

      (b)     in a manner that is reasonably likely to imply a false or misleading representation concerning the goods or service, as contemplated in section 115;

    1.  

      (c)     if the supply, purchase, sale or possession of the goods or service is unlawful;

    1.  

      (d)     to be supplied in a manner that is inconsistent with any law; or

    1.  

      (e)     in a manner that —

      1.  

        (i)     is degrading to the dignity of any person,

      1.  

        (ii)     depicts, simulates, suggests, represents or reasonably appears to promote a use or application of the goods or service that is inconsistent with any law, or

      1.  

        (iii)     implies or expresses a preference for any particular group of consumers distinguishable from the general population on the basis of a prohibited ground of unfair discrimination set out in the Constitution of Saint Lucia except to the extent that particular goods or a service is reasonably intended or designed to satisfy specific needs or interests that are common to or uniquely characteristic of the particular group of consumers.

    (2)   A supplier who contravenes this section commits an offence and is liable on summary conviction to a fine not exceeding $3,000 or to imprisonment for a term not exceeding 1 year or to both.
