144. Loss or damage caused by contravention of recall notice
Where a supplier fails to comply with a compulsory recall notice under section 140 and a person suffers injury, loss or damage by reason of a defect in, or a dangerous characteristic of, the goods or by reason of not having particular information as to a characteristic of the goods, that person is deemed for the purpose of this Act to have suffered the injury, loss or damage by the failure of the supplier to comply with the compulsory recall notice.
