171.   Prohibition and privilege

    (1)   A person shall not, without the consent in writing given by or on behalf of the Chairperson, publish or disclose to another person, otherwise than is necessary in the course of his or her duties, the contents of any documents, communication or information whatsoever, which relate to, and have come to his or her knowledge in the course of his or her duties under this Act.

    (2)   Anything said or information supplied or any document produced by any person for the purpose of, or in the course of an investigation by the Department or proceeding before the Council under this Act, is privileged in the same manner as if the investigation by the Department or proceeding were a proceeding in a court of law.     (3)   A person who contravenes this section commits an offence and is liable on summary conviction to a fine not exceeding $5,000 and in default of payment of the fine, to imprisonment for a term not exceeding 2 years or to both.
