(1) Subject to subsection (3), this Act applies to all persons involved in trade or business whether through the purchasing or supplying of goods or services.
(2) In determining whether this Act applies to a person or transaction, the Tribunal or a court shall consider the real substance of the person or transaction. (Substituted by Act 14 of 2021)
(3) The Minister may by Order, subject to affirmative resolution, exempt categories of trade or business from the application of this Act.
