123.   Liability to pay damages

  1.  

    (1)   A person who is convicted of an offence under section 116, 117, 118, 119, 120 or 121, in addition to criminal liability for the offence, is liable, at the suit of any person who has sustained pecuniary loss as a result of having purchased or sold securities at a price affected by the act or transaction which comprises or is the subject of the offence, to an action for damages in respect of the loss concerned.

    (2)   Subsection (1) does not limit or diminish any civil liability which any person may incur under any other law.
