155.   Offences and penalties

  1.  

    (1)   A person who commits an offence under section 21(3), 40(3), 67(5), 69(2), 77(5), 82(2), 87(4), 88(2), 89(2), 131, 134(3), 135(5), 136(3) or 137(5) is liable on summary conviction—

    1.  

      (a)     in the case of an individual, to a fine of $50,000 or to imprisonment for one year or to both;

    1.  

      (b)     in the case of a company, to a fine of $100,000; and if the offence is a continuing offence, the individual or company is liable to a further fine not exceeding $1,000 for every day that the offence continues after conviction.

    (2)   A person who contravenes or fails to comply with any other provision of this Act, where the provision does not expressly create an offence or provide for a penalty, commits an offence and is liable on summary conviction—

    1.  

      (a)     in the case of an individual, to a fine of $100,000;

    1.  

      (b)     in the case of a company, to a fine of $200,000.
