28.   Demolition order

  1.  

    (1)   Where, in respect of an area included in an approved settlement clearance scheme, the Corporation determines that a building should be demolished, it shall make, and serve on the owner or his or her representative a demolition order ordering the demolition of the building within a time specified in the order.

    (2)   Where the owner of a building subject to a demolition order, or his or her representative, fails to give effect to the order within the time specified or within such extended time permitted by the Corporation, the Corporation shall carry out the demolition.

    (3)   Where the Corporation carries out demolition under subsection (2) it may sell or otherwise dispose of any materials resulting from the demolition and the amount realised from the sale shall be applied towards any expenses incurred by the Corporation in carrying out the demolition.

    (4)   In the event that there is a surplus in the hands of the Corporation from the amount realised by the sale after deducting any expenses, the Corporation shall pay the surplus to the owner or his or her representative.
