24.   Approval of scheme by Minister

  1.  

    (1)   The Minister may, if he or she thinks fit, after consultation with Cabinet and after considering any objections to the scheme properly made, approve the scheme submitted by the Corporation or part thereof, either with or without modification, and the scheme or the part of it approved by the Minister shall be binding on the Corporation.

    (2)   Where the Minister considers the scheme inadequate he or she may refuse to approve it and may require the Corporation to prepare and submit to him or her a revised scheme within such time as the Minister may fix.

    (3)   The Minister shall not approve of any scheme unless he or she is satisfied that—

    1.  

      (a)     the size of the area is such that the housing condition in the area can be remedied within a reasonable period;

    1.  

      (b)     the financial resources of the Corporation are or will be sufficient for the purpose of carrying into effect such scheme;

    1.  

      (c)     the Corporation has provided, or secured alternative accommodation for low income households which will be displaced by the scheme.

    (4)   The modification referred to in subsection (1) may include the alteration of the defined area so as to exclude land from the area but not so as to add land thereto.
