17.   Powers of Corporation in relation to unfit building

  1.  

    (1)   Where in the opinion of the Corporation a building to which this Act applies—

    1.  

      (a)     is derelict;

    1.  

      (b)     is unfit for human habitation;

    1.  

      (c)     creates a nuisance; or

    1.  

      (d)     is injurious or likely to be injurious to health,

  1.  

    the Corporation may serve on the owner of the building notice in writing requiring him or her to demolish, secure, repair or rebuild the building to the satisfaction of the Corporation within a time to be specified in the notice.

    (2)   If an owner on whom a notice is served under subsection (1) fails to comply with the requirements of the notice, the Corporation may carry out the works required to be done and in the case of a demolition may sell or otherwise dispose of any materials resulting from such demolition.

    (3)   Subject to subsection (4), the expenses incurred by the Corporation under subsection (2) may be recovered as a civil debt due to the Corporation.

    (4)   Where the Corporation carries out demolition under subsection (2) it may sell or otherwise dispose of any materials resulting from the demolition and the amount realised from the sale shall be used to defray any expenses incurred by the Corporation in carrying out the demolition.

    (5)   In the event that there is a surplus in the hands of the Corporation from the amount realised by such sale after deducting any expenses, the Corporation shall pay the surplus to the owner or his or her representative.

    (6)   In determining for the purpose of this section whether a house is fit for human habitation, regard may be had to the extent, if any, to which it suffers from sanitary defects.

    (7)   Where in consequence of any notice issued under this section persons will be displaced, the Corporation shall first satisfy itself that suitable alternative accommodation is available for such persons.
