362.   Claims of owner of wreck

  1.  

    (1)   The owner of any wreck which is in the possession of a receiver, upon establishing his or her claim to the wreck to the satisfaction of the receiver within 6 months from the time when the wreck came into the possession of the receiver, shall, on paying the salvage fees and other expenses due, be entitled to have the wreck or the proceeds thereof delivered up to him or her.

    (2)   Where any wreck or other article belonging to or forming part of a foreign vessel which has been wrecked in Saint Lucian waters or on the shores of Saint Lucia or belonging to and forming part of the cargo thereof, is found on or near the shores of Saint Lucia or is brought into any port in Saint Lucia, the consular officer of the country to which the vessel belongs or, in the case of cargo, the consular officer of the country of which the owners or such cargo are citizens shall, in the absence of the owner and of the master or other agent of the owner, be deemed to be the agent of the owner, so far as relates to the custody and disposal of the wreck or such other article.
