18.   Cancellation of registration

  1.  

    (1)   The registration of a ship under section 12 shall be cancelled if at any time the ship —

    1.  

      (a)     appears to be registered also in a foreign registry; or

    1.  

      (b)     ceases to comply with the qualifications for the ownership of Saint Lucian ships as required by section 12; or

    1.  

      (c)     appears to have been lost or broken up.

  1.  

    (1A)   The registration of a ship under section 12A shall be cancelled if at any time —

    1.  

      (a)     in the case of section 12A(a) and (b) —

      1.  

        (i)     the ship is or has been involved in a contravention of this Act,

      1.  

        (ii)     the ship is not seaworthy or is substandard,

      1.  

        (iii)     the registry of the ship closes or the ship's registration is annulled,

      1.  

        (iv)     the dispensation under section 19A is revoked or withdrawn,

      1.  

        (v)     the ship is lost, taken by an enemy, burnt or broken up; or

    1.  

      (b)     in the case of section 12A(a) —

      1.  

        (i)     the ship has not been, or will not be, used to engage in international trade, or

      1.  

        (ii)     a collective agreement relating to the crew of the ship, made between the owner of the ship and the ship's seafarers' bargaining unit is not in force when the ship is used to engage in international trade; or

    1.  

      (c)     in the case of section 12A(b) —

      1.  

        (i)     the charterer transfers his or her rights and obligations under obligations of the demise charter to another person so that the charterer is no longer under a contractual obligation to the owner of the ship in respect of the operation, management and control of the ship,

      1.  

        (ii)     the demise charter is terminated,

      1.  

        (iii)     the rights and obligations of the charterer are transferred; or

    1.  

      (d)     any other prescribed ground.
