195.   Penalty on stowaways

  1.  

    (1)   Any person who secrets himself or herself and goes to sea in ship without the consent of either the owner master, or a mate or of the person in charge of the ship or of any other person entitled to give that consent, commits an offence and is liable on summary conviction to a fine not exceeding $1,000 or to a term of imprisonment not exceeding 3 months or to both such fine and imprisonment.

    (2)   Every person who goes to sea in a ship without the consent mentioned in subsection (1) shall, so long as he or she remains in the ship, be deemed to belong to the ship, and be subject to the same laws for preserving discipline, and to the same fines and punishments for offences constituting or encouraging a breach of discipline, as if that person were a member of the crew and had signed the crew agreement.
