DRIVING CODE

1.   Licence plate

  1.  

    (1)  A person shall not use a motor vehicle or trailer on a road unless the plates constituting the licence plates are fixed one on the front and the other on the back of the motor vehicle or trailer in an upright position, so that every letter or figure on the plate is upright and easily distinguishable —

    1.  

      (a)     in the case of the plate placed on the front of the motor vehicle or trailer, from in front of the motor vehicle or trailer; or

    1.  

      (b)     in the case of the plate placed on the back of the motor vehicle or trailer, from behind the motor vehicle or trailer.

  1.  

    (2)  In the case of a motor cycle, the plate fixed on the front of the motor cycle may, if it is a plate having duplicate faces be fixed so that from whichever side the motor cycle is viewed the letter or figures on one or other face of the plates are easily distinguishable, though they may not be distinguishable from the front of the motor cycle.

  1.  

    (3)  Subject to paragraph (1), the plates forming the licence plate shall be fixed on the motor vehicle or trailer in the position indicated in the particulars given in the application for the registration of the motor vehicle or trailer or subsequently furnished.

2.   Use of motor vehicle or trailer on road at night

  1.  

    A person shall not use a motor vehicle or trailer on a road at night —

    1.  

      (a)     without 2 lighted lamps one on each side at the front of the motor vehicle or trailer; or

    1.  

      (b)     without carrying 2 lighted lamps showing red lights one on each side at the rear of the motor vehicle or trailer of such intensity as to indicate clearly its presence on the road.

3.   Spot-lights or other swivelling lights

  1.  

    A person shall not use a motor vehicle or trailer on a road that carries spot-lights or other swivelling lights without the authority of the Licensing Authority.

4.   Travelling backwards

  1.  

    The driver of a motor vehicle or trailer shall not cause the motor vehicle to travel backwards, for a greater distance or time than may be requisite for the safety or convenience of the occupants of the motor vehicle or trailer and of the passengers or other traffic on the road.

5.   Keeping to left

  1.  

    The driver of a motor vehicle or trailer shall not fail to keep the motor vehicle on the left of the road without sufficient cause.

6.   Overtaking on the right

  1.  

    The driver of a motor vehicle or trailer shall not fail to keep to the right offside when overtaking other motor vehicles and trailers.

7.   Quitting motor vehicle

  1.  

    The driver of a motor vehicle shall not quit a motor vehicle or trailer without applying brakes and stopping the engine.

8.   Staying on side to be overtaken

  1.  

    The driver of a motor vehicle or trailer, when being overtaken by other vehicles shall not fail to drive as close to the left side of the road as possible so as to allow such other vehicles to pass, or failing to give as much space as possible for the passing of other traffic or increasing the speed of the vehicle he or she is driving whilst being overtaken by any other vehicle.

9.   Overtaking without clear view

  1.  

    (1)   A person shall not drive a motor vehicle or trailer so as to overtake other traffic without a clear or unobstructed view of the road ahead and of any intersecting roads or overtaking other traffic when the road ahead is not clear for a sufficient distance to enable the person to overtake and get back to his or her proper side before meeting any traffic coming from the opposite direction and without causing the motor vehicle or trailer which is being overtaken to alter its speed.

10.   Overtaking on corner, intersection, brow or hump back bridge

  1.  

    The driver of a motor vehicle or trailer shall not overtake other traffic when rounding a corner or when roads intersect or fork or where the road passes over the brow of a hill or over a hump back bridge or in any other circumstances where the person driving cannot see sufficiently far ahead to overtake with safety.

11.   Obstructing traffic

  1.  

    The driver of a motor vehicle or trailer shall not cross a road or turn in a road or proceed from one road into another road or drive from a place which is not a road into a road, or from a road into a place which is not a road, when unable to do so without obstructing any other traffic on the road.

12.   Turning left into another road

  1.  

    The driver of a motor vehicle or trailer shall not turn from one road into another road to the left without keeping as close as possible to the left of each road.

13.   Turning right into another road

  1.  

    The driver of a motor vehicle or trailer shall not turn from one road into another to the right without driving round the point of intersection of the 2 roads, or keeping as close as possible to the left of each road.

14.   Distance from corner

  1.  

    A person shall not stop a motor vehicle or trailer within a distance of 20ft. from a corner, drive way, carriageway, or private road leading from a public road unless compelled to do so by the necessities of traffic on the road.

15.   Drawing up alongside

  1.  

    A person shall not draw up a motor vehicle or trailer alongside any other motor vehicle or back motor vehicle or trailer to the curb-stone of any foot-path or to the side of any road except for the purpose of turning.

16.   Riding outside of motor vehicle or trailer

  1.  

    An owner or a driver of a motor vehicle or trailer shall not allow a person to ride outside of a motor vehicle or trailer.

17.   Broken down motor vehicle or trailer

  1.  

    An owner or a driver of a motor vehicle or trailer which has broken down shall not leave or permit the motor vehicle or trailer to be left on any public road, without taking requisite steps to indicate its presence and position, by lighting or otherwise, to other persons using the road, or failing to take immediate steps to have it removed to as near left of the road as possible.

18.   Clearing the way for emergency vehicle

  1.  

    A person using a motor vehicle or trailer on a road shall not fail, on the approach of any emergency vehicle including a police vehicle, fire brigade or ambulance using a siren or otherwise indicating emergency passage, to draw up close to the left-hand side of the road and stop, leaving the centre of the road clear for the passage of the emergency.

19.   Filling Petrol

  1.  

    The driver of a motor vehicle or trailer shall not put petrol or cause petrol to be put into a receptacle on or adjacent to any motor vehicle or into the tank of a motor vehicle or trailer while the engine is running, or while any light, other than electric light, is alight on the motor vehicle or trailer or smoking or lighting a match or exposing a naked light in close proximity while petrol is being so filled.

20.   Noise

  1.  

    A person shall not drive or be in charge of a motor vehicle or trailer that causes a loud noise or from which a loud noise can be heard so as to be annoying or disturbing to any person.

21.   Tyres

  1.  

    A person shall not use a motor vehicle or trailer on a road without all the tyres being maintained in such condition as to be free from any defect that might in any way cause damage to the surface of the road, or danger to persons in or on the vehicle or to any person using the road.

22.   Parking in a prohibited place

  1.  

    A person shall not park a motor vehicle or trailer in a prohibited place.

23.   Tint

  1.  

    A person shall not drive a motor vehicle or trailer on a road if the motor vehicle or trailer has a tint on the front windscreen unless the tint is less than 8 inches in height and is placed at the top of the front windscreen.
